Order Before: CELEBREZZE, ENGEL and MARTIN, Circuit Judges Horace Paul Williams appeals from a final judgment of the district court denying relief in an action brought under Title VII of the Civil Rights Act, 42 U.S.C. § 2000e et seq. He alleged that Arkansas Best Freight, Inc. (Arkansas) unlawfully discharged him on December 31, 1976, on account of his race. A careful review of the record clearly discloses that the judge did not err in holding that Williams' discharge and other treatment complained of was not the result of discrimination against him because of his race, but rather was a result of an unsatisfactory work record which disclosed that Williams was either absent or late on 108 occasions in 1975 and on 22 occasions in 1976. The court also concludes that the district judge properly submitted the factual issues to the magistrate and that both the district judge and the magistrate afforded the plaintiff ample opportunity to present his case. Accordingly, IT IS ORDERED, that the judgment of the district court is affirmed in appeal No. 78-3334. IT IS FURTHER ORDERED AND ADJUDGED that the appeal in No. 78-3335, Arkansas's cross-complaint for attorney fees, which appellee expressly waived in the event we affirmed the district court's judgment, in No. 78-3334, is dismissed.
